out-of-state to in-state for tuition purposes: Please

possible to make certain that you understand the guidelines outlined below
or to obtain additional information.
Things
to Remember:
There must be conclusive evidence of the student’s intent to permanently
establish his/her domicile in Texas.
It is the student’s responsibility
to determine if the guidelines are in effect when applying for
residency.

Independent
Individual Basing Residency on Self (must be 18 years of age or older):
Students who are
classified as a " non-resident" must pay the out-of-state tuition rates prior to
establishing Texas residency.
Establishment of Residence:
A person who 1) graduated from a Texas public or accredited private high
school, 2) resided in Texas the 36 months immediately preceding the date
of graduation or receipt of the diploma equivalent, and 3) resided in
Texas the 12 consecutive months preceding the census date of the
academic semester in which the person enrolls in an institution or an
independent individual who moves into the state and is gainfully
employed within the State of Texas for a period of 12 consecutive months
prior to enrolling in an institution of higher education is entitled to
classification as a resident for tuition purposes. The student may be
required to complete a set of Core Residency Questions and provide
supporting documentation (see below). If such residence, however, can
be shown
not
to have been for the purpose of establishing domicile and residence but
to have been for some other purpose, the individual is not entitled to
be classified as a resident.
Reclassification:
A person who has
enrolled in an institution of higher education prior to living in the
state for 12 months and who has been classified as a non-resident upon
first enrollment in an institution of higher education is presumed to be
non-resident for the period during which he/she continues as a student.
However, after residing in the state for 12 consecutive months, the
student may apply for reclassification as a resident for tuition
purposes provided unequivocal proof of establishment of domicile in
Texas should be provided as outlined below.
Materials to the determination of the establishment of a domicile in
Texas are: business or personal facts or actions unequivocally
indicative of a fixed intention to reside permanently in the state (see
below). The student must complete a set of Core Residency Questions and
provide supporting documentation if requested.

REQUIRED
1. Established
a domicile in Texas for 12 consecutive months immediately preceding
enrollment with the intent to make Texas a permanent home.
2. Maintained
a residence in Texas for 12 consecutive months immediately preceding
enrollment with the intent to make Texas a permanent home;
Documentation that can Support the Establishment of a Domicile and
Demonstrate the Maintenance of a Resident in Texas for 12 Months
-
Employment in Texas at least 12 consecutive months prior to
enrollment; or
-
One of the following: 1) Title to real property in Texas for 12
months, 2) Ownership of business in Texas for 12 months, 3)
State or local license to conduct business in Texas 12 months; or
-
For homeless, 12 months’ social services in Texas
Documents that may be Used to Demonstrate Maintenance of a Residence in
Texas for 12 Months
-
Utility bills for
the 12 months preceding the census date;
-
-
A transcript from a
Texas institution showing presence in the state for the 12 months
preceding the census date;
-
A Texas driver’s
license or Texas ID card with an expiration date of not more than
four years;
-
Cancelled checks
that reflect a Texas residence for the 12 months preceding the
census date;
-
A current credit
report that documents the length and place of residence of the
person or the dependent’s parent.
-
Texas voter
registration card that has not expired.
-
Pay stubs for the
12 months preceding the census date;
-
Bank statements
reflecting a Texas address for the 12 months preceding the census
date;
-
Ownership of real
property with copies of utility bills for the 12 months preceding
the census date.
-
Registration or
verification from licensor, showing Texas address for licensee;
-
Written statements
from the office of one or more social service agencies, attesting to
the provision of services for at least the 12 months preceding the
census date.
-
Lease or rental of
real property, other than campus housing, in the name of the person
or the dependent’s parent for the 12 months preceding the census
date.
-
Execution of a
currently valid Last Will and Testament that has been deposited with
a county clerk in Texas for at least the 12 months prior to
enrollment and indicates the person is a resident of Texas.
It is the student's responsibility to determine if the above
guidelines are in effect when applying for residency.

Student Basing
Residency on Parent:
The residency of a minor or dependent is based on one of the following
circumstances:
1.
The residence of the parent who has claimed the dependent for federal
income tax purposes both at the time of enrollment and for the tax year
preceding enrollment:
2.
The residence of the parent or court-appointed legal guardian with whom
the dependent or minor has physically resided for the 12 months prior to
enrollment;
3.
The residence of the parent or legal guardian who has joint or single
custody of the child, if that individual is not delinquent on the
payment of child support; or
4.
The residence of the person to whom custody was granted by court order
(e.g., divorce decree, child custody actions, guardianship or adoption
proceedings), provided custody was granted at least 12 months prior to
the student’s enrollment and was not granted for the purpose of
obtaining status as a resident student.
The parent or legal guardian must have resided in Texas for at least 12
consecutive months immediately preceding the student’s enrollment and
must meet the criteria indicative of a fixed intention to reside
permanently in Texas as outlined on Page 1. A copy of one or more of the
appropriately dated documents outlined on Page 1 of this sheet may be
required.
Non-U.S.
Citizen Basing Residency on Self:
A student who 1) graduated from
a Texas public or accredited private high school, 2) resided in Texas
the 36 months immediately preceding the date of graduation or receipt of
the diploma equivalent, 3) resided in Texas the 12 consecutive months
preceding the census date of the academic semester in which the person
enrolls in an institution; and 4) provides the institution an affidavit
stating that the individual will file an application to become a
permanent resident at the earliest opportunity he/she is eligible to do
will be classified as resident for tuition purposes.
The student may not
be classified as a resident for tuition purposes unless he/she holds a
current immigration status that is eligible to domicile in the United
States and has resided in Texas a minimum of 12 consecutive months. The
following non-U.S. Citizens who are eligible to establish a domicile in
Texas under the law and can obtain Texas residency, if they meet the
basic residency requirements (page 1), are listed below:

Holder of the I-766 card that has not
expired

Holder of the I-688, I-688a or I-699b
card that has not expired

Letter from INS showing approval under
the visa diversity (lottery) program

approved, or letter from INS showing grant of deferred action
status

Copy of fee receipt issued by INS when
the petition was filed

Holder of the I-485 – The application to
register Permanent Residence or adjust status
-
Refugees, Asylees, Parolees, Conditional
Permanent Residents (holding I-551 cards which have not expired),
Temporary Residents (holding I-688, I-688a, or I-688b cards which
have not expired)
-
Holder of one of the following visa
types (A-1, A-2 who is a dependent of A-1, A-3, E-1, E-2, G-1, G-2,
G-3, G-4, G-5, H-1B, I, K-1, K-2, K-3, K-4, L-1, L1-a, L1-b, L-2,
NATO 1-7, O-1, O-3 who is a dependent of O-1, R-1, R-2, T-1, T-2,
T-3, T-4, U-1, U-2, U-3, U-4, V-1, V-2, V-3
Special note to
students who are undocumented and who do not have college work prior to
Fall 2001: Please contact the Office of Admissions for additional
information. You may qualify for Texas residency under HB 1403. SB 1528

Non-U.S. Citizen
Basing Residency on Parent:
-
The parent of the student must qualify under
one of the requirements listed above in the “The Non-U.S. Citizen Basing
Residency on Self” section and meet the same criteria outlined on Page 1
of this sheet.
-
The student must hold a current immigration status that is eligible to
domicile in the United States.
In addition to the documentation required
on Page 1 of this sheet, both the parent and the student must present
the appropriate immigration status documentation.
It is the student's responsibility to determine if the above
guidelines are in effect when applying for residency.
